Article 2.3.3 Future Evolution and Autonomy in IP Registration
(i) Where ICT-originating intellectual property assets (e.g. trademarks, patents, or software tools) obtain enforceability or reciprocal recognition under international law or Host Country regulations in the future, the Operator may:
(i) Establish a formal ICT intellectual property registry;
(ii) Create rules for ICT-originating applications or registrations;
(iii) Coordinate bilateral recognition frameworks with other jurisdictions.
(ii) In relation to any potential future ICT intellectual property systems, the Operator may consider:
(i) Predictability and fairness;
(ii) Respect for international standards and common law principles;
(iii) Interoperability with existing enforcement mechanisms;
(iv) Consistency with the World Trade Organisation Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS).
