Article 3.22 Proportionality

All administrative actions shall comply with the principle of proportionality, namely:

1. Legitimate Purpose: The measure shall serve a legitimate, i.e., legally recognised purpose in the interest of the ICT.

2. Suitability: The measure shall be suitable for achieving or contributing to the intended purpose.

3. Necessity: There shall be no less intrusive means that could achieve the purpose just as effectively but with less impact on the rights of the affected party.

4. Reasonableness: The measure shall strike a reasonable balance between the intended purpose and the impact on the affected party. A balancing act is conducted between the interests of the ICT and the rights of the individual.
