Article 3.52 Building Safety Requirements

(a) Every property owner shall ensure that all buildings, structures, works, and building systems on their property comply with applicable structural integrity, fire safety, health and safety, accessibility, environmental, utility, and operational safety requirements under this ICT Code, the Urban Development Plan, and any applicable supplementary instruments.
(b) The Operator may issue, adopt, recognise, or update building safety standards, design standards, engineering standards, fire protection standards, construction compliance procedures, inspection requirements, certification requirements, and maintenance obligations for buildings and building works within the ICT.
(c) Such standards and procedures may include different approval, notification, certification, deemed-to-satisfy, competent-person, expert-review, or performance-based pathways depending on the nature, scale, complexity, risk profile, or innovative character of the proposed building works.
(d) The Operator may recognise international standards, foreign standards, professional certifications, engineering codes, product approvals, or other technical standards where the Operator considers them suitable for application within the ICT.
(e) Innovative, experimental, non-standard, or performance-based building methods, materials, systems, or technologies may be permitted where the property owner demonstrates, to the satisfaction of the Operator or a competent person recognised by the Operator, that equivalent or superior safety, durability, resilience, and performance outcomes are achieved.
(f) Every property owner shall be responsible for the proper maintenance, repair, safe operation, and lawful use of buildings, structures, systems, and properties, including waste, water, electricity, drainage, sanitation, access, fire-safety systems, and other utilities or services.
(g) The Operator may require inspections, reports, remedial works, temporary closure, restrictions on use, or other reasonable measures where a building, structure, system, or property presents a risk to safety, health, neighbouring properties, public areas, infrastructure, or the orderly operation of the ICT.
(1) Every property owner is obliged to comply with the standards for structural integrity and fire protection, as regularly published by the Operator.
(2) Every property owner is responsible for the proper maintenance of buildings and properties including waste, water and electricity management.
