Article 4.26 Good Faith, Non-Retaliation, and Continuity of Functions

(a) (1) All parties shall act in good faith throughout the procedures set out in this Chapter.

(b) (2) No person shall be subjected to retaliation, discrimination, or adverse treatment for initiating or participating in any dispute resolution process under this Chapter.

(c) (3) Unless otherwise ordered by the arbitral tribunal or emergency arbitrator, the initiation of proceedings under this Chapter shall not suspend or invalidate the lawful exercise of official functions of the ICT, provided that such functions are exercised in good faith and in compliance with applicable law.
