Article 4.37 Jurisdiction in Criminal Matters

(a) (1) Subject to the Constitution of the Host Country and applicable Host Country law as may be set out in Part 5 of this ICT Code, the IC Court shall have jurisdiction to hear and determine criminal offenses committed within the territorial domain of the ICT.

(b) (2) Criminal offenses, or categories of offenses, that are expressly reserved by Host Country law to the jurisdiction of courts outside the ICT shall remain subject to the jurisdiction of such courts.

(c) (3) An offence shall be regarded as committed within the ICT where the conduct constituting the offence, or a substantial part thereof, occurs within the territorial domain of the ICT, subject to overriding Constitutional or statutory provisions.
