Article 6.3 Definitions

(a) 6.3.1 In this Code, unless the context makes it clear that something different is meant:

accused means a person accused of an offence;

advocate means a legal representative who is entitled to exercise a right of audience in the court under ICT law, whether appearing for the prosecution, the defence, or otherwise, and includes a prosecutor;

appeal court means a court established or designated by ICT law to hear and decide appeals from cases decided by a court;

case or criminal case means a prosecution under this Code of an offence, and includes an appeal;

convicted person means a person who has been convicted of an offence;

conviction includes a finding of guilt and a conviction of an offence for which an order is made discharging the offender absolutely or conditionally, and “convicted” shall be construed accordingly;

court means a court established under the laws of the ICT upon which a law of the ICT confers jurisdiction to exercise the role of courts under this Code, and where the context permits includes reference to a judge;

crime has the meaning given in the ICT Criminal Code;

criminal law means any law applying in the ICT that provides for offences;

currency unit has the meaning given in the ICT Criminal Code;

judge means a judge appointed to a court or an appeal court under ICT law;

misdemeanour has the meaning given in the ICT Criminal Code;

offence means a crime or a misdemeanour;

party to a case means:

(A) the accused (and where the context permits, includes the accused’s advocate);

(B) the convicted person (and where the context permits, includes the convicted person’s advocate); and

(C) the prosecutor (and where the context permits and the prosecutor is represented by an advocate, includes that advocate);

City Security means a person appointed to the role of City Security officer by the City Operator;

practice direction means practice directions issued under this Code from time to time;

prosecutor means:

(D) a public officer of the ICT charged by ICT law with prosecuting persons accused of offences;

(E) for misdemeanours, a person described in paragraph (a) or a City Security officer of the ICT;

Registrar means the Registrar of the Criminal Jurisdiction appointed under this Code from time to time or a court officer exercising a function of the Registrar under delegation; and

registry means the court registry established under this Code for the purpose of administering matters arising, and prosecutions brought, under this Code.

(b) 6.3.2 In this Code, reference to an offence includes reference to an alleged offence.
