Amendment and Stability

  • Amendments only permitted by:

    • Mutual agreement, or
    • Exceptional Event

In the event of an Exceptional Event - defined as a material, unforeseen circumstance that poses a serious threat to the continued viability, legal standing, or core functionality of the ICT - the Operator may adopt limited regulatory amendments to address the issue. Such amendments are subject to the following safeguards:

  • Proportionality: The regulation must be strictly limited to what is necessary to respond to the Exceptional Event. This includes proportionality in scope, legal effect, and - where appropriate - a fixed or time-bound duration for the measure.
  • Resident Right to Referendum: 5% or more of adult residents may submit a petition challenging the amendment, subject to defined safeguards and procedural mechanisms.
  • Resident Exit and Potential Refund Rights: Regardless of the Referendum outcome, materially affected residents may, in certain circumstances, terminate their Residency Agreement and receive a pro-rata refund of any unearned residency fees.

The above reinforces stability and protects against arbitrary change.
