Resident rights afforded to ICT Residents under Residency Agreement - Summary for ease of reference

• Right to physically reside, work, and operate a business in the ICT.
• Right to do anything not expressly prohibited by the Residency Agreement or Applicable Laws.

• Protected personal freedoms, including:

  • Freedom of movement within the ICT.
  • Freedom of thought, conscience, and religion (provided that Residents do not interfere with Host Nation politics).
  • Freedom of expression, subject to Applicable Laws and political neutrality.
  • Freedom from unreasonable surveillance, interception, search, or seizure of person, personal effects, or property.
  • Right to property and peaceful enjoyment thereof.
  • Freedom to contract and engage in lawful activities.
  • Right to self-defence and access to emergency assistance.
  • Right to life and physical integrity, including protection from harm by the Operator.
• Right to be protected from interference by the Operator unless there is a clear legal basis under the Agreement or Applicable Laws, and subject to the principle of proportionality.
• Right to challenge acts or omissions by the Operator that significantly affect Resident rights – e.g., Referendum.

• Right to have disputes resolved through a tiered process:

  • Good-faith negotiation;
  • ICT Ombudsman Process; and
  • Independent arbitration (with option for ad-hoc tribunal).
• Right to seek compensatory damages, legal costs, and injunctive relief for significant Operator breaches of Residency Agreement.
• Right to initiate or participate in a binding Referendum to challenge unilateral amendments by the Operator made in response to Exceptional Events.

• Right to basic governance services, including:

  • City security and emergency response
  • Independent dispute resolution infrastructure
• Right to claim damages or seek a reduction in the Residency Fee if the Operator fails to deliver required basic governance services.
• Optional access to Additional Services and e-Government Services.
• Right to transparency and continuity in the event of Operator insolvency, including appointment of a Replacement Operator.
• Extension of all rights and protections to legally recognised Dependents, subject to the same terms.
• Right to choose education options freely for minor Dependents (formal providers or home-based), with reasonable oversight.
• Right to receive communications and notices in English and by electronic means.
• Right to lawful data protection, with personal data processed only where necessary to deliver basic governance services.

Note: The above rights are to be exercised in such a way that the corresponding rights of other Residents are not impaired.
