Article 2.5.12 Supplementary Guidelines
(a) Purpose and Scope:
This Article sets out the authority of the Operator to issue supplementary guideline instruments supporting the implementation of family law under this ICT Code. It provides a unified basis for administrative clarity, procedural consistency, and adaptation to evolving international standards.
(b) Supplementary Instruments Permitted:
(i) The Operator, or a specialised body authorised by it, may issue supplementary interpretive guidelines, procedural protocols, or model clauses or instruments to support the application of this Chapter.
(ii) These instruments may address, without limitation:
(iii) Procedural standards, evidentiary requirements, and application forms for family law proceedings;
(iv) Eligibility criteria and safeguards applicable to adoption, surrogacy, and assisted reproductive technologies (ART);
(v) Templates for family law agreements, parenting plans, and cross-border recognition procedures;
(vi) Rules for registration, use, and revocation of powers of attorney, advance directives, and guardianship arrangements; and
(vii) Privacy, notification, and appeal mechanisms relating to changes of personal status.
(c) Status and Legal Effect:
Supplementary instruments shall not override or amend the provisions of this Code, but may:
(i) Clarify technical, medical, or administrative issues;
(ii) Fill procedural gaps consistent with the Code’s principles;
(iii) Guide ICT Court interpretation where consistent with justice and proportionality.
(d) Publication and Access:
All supplementary regulations and guidelines issued under this Article shall be published in an accessible format and made available to ICT Residents, legal professionals, and relevant stakeholders via the Operator or a body appointed by it.
