Article 3.12 Interpretation, Supplementation and Legal Gaps

(a) (1) The ICT operates under a voluntary, rules-based, contractually enforceable legal framework and shall be interpreted as such.

(b) (2) Gaps, ambiguities, or silent areas in this ICT Code may be resolved through:

(i) Interpretative rulings or precedent issued by the ICT Court or ICT ADR tribunals;

(ii) Supplementary rules issued in response to Exceptional Events, subject to procedural safeguards and proportionality. Such rules shall not override the provisions of this ICT Code unless expressly authorised;

(iii) Supplementary guidelines or forms for specific areas under this ICT Code, as set out in this ICT Code. Such supplementary instruments shall not override the provisions of this ICT Code in the event of inconsistency.

(iv) Referenda or feedback mechanisms where explicitly enabled under the Residency Agreement or Investor Agreement (as applicable).
