Article 3.2 Fundamental Rights

1. Everyone has the right to be left alone by the Administration and others, provided they do not violate applicable law.

2. All residents have the right to freely express and disseminate their opinions and to inform themselves from generally accessible sources.

3. The general right to freedom of contract applies unless otherwise specified in this Code. This includes the freedom not to contract with someone.

4. In principle, all economic, professional, and other activities are permitted without authorization unless this Code provides for authorization or notification requirements.

5. All residents have the right to assemble peacefully and without weapons without prior registration or permission. For public demonstrations, the Administration provides designated areas that do not interfere with general traffic.

6. Personal data and private communication shall not be accessed without the consent of the affected party. Restrictions apply only in the context of criminal prosecution in cases specified therein.

8. Property and inheritance rights are guaranteed. The content and limits of property are determined by this Code.

9. The right to self-defence and defence of others is fully recognised. Justice need not give way to injustice. Corresponding measures shall not be grossly disproportionate.

10. Everyone is entitled to be heard in a proceeding. This includes the right to express themselves, present evidence, and make submissions.

19. Deprivations of liberty may only occur on a legal basis and in compliance with procedural rules.

20. An act may only be punished where it was legally prohibited at the time it was committed.
