Article 3.34 Conditions for the Use of Firearms

(a) (1) The use of firearms is only permissible where the general conditions for the use of direct force are met and if simple physical force, available aids to physical force, or carried striking weapons have been used unsuccessfully or their use clearly promises no success. Firearms may only be used against persons if City Security objective cannot be achieved through the use of weapons against objects.

(b) (2) The use of firearms is prohibited if it is clear that uninvolved persons are likely to be endangered. This does not apply if the use of firearms is the only means to avert an imminent danger to life.
