Article 3.54 Environmental Protection
(a) The Administration may regulate, restrict, or prohibit activities within the ICT that may affect environmental protection, biodiversity, natural resources, public health, neighbouring properties, public areas, infrastructure, or the ecological integrity of the ICT.
(b) Without limitation, such regulation may include rules concerning:
(i) the keeping, breeding, import, release, relocation, or control of plants, animals, insects, fish, or other living organisms;
(ii) invasive species, pests, disease vectors, and organisms that may cause ecological, agricultural, health, or safety risks;
(iii) the collection, possession, trade, disturbance, harm, or removal of endangered, protected, culturally significant, or ecologically sensitive species;
(iv) waste, water, drainage, emissions, noise, light, odour, chemicals, hazardous materials, soil, vegetation, waterways, and natural features;
(v) conservation areas, open spaces, habitat protection, landscaping, tree protection, and biodiversity measures; and
(vi) any matter required to ensure compliance with applicable Host Country law or international environmental commitments expressly applicable within the ICT.
(c) The Administration may issue supplementary instruments setting out environmental standards, prohibited activities, permit requirements, reporting obligations, inspection powers, remediation duties, penalties, and enforcement procedures.
(d) The Administration, as the body responsible for infrastructure areas, public areas, environmental systems, and the orderly management of the ICT territory, may bring claims, issue directions, require remediation, or take enforcement action against any person responsible for conduct that may adversely affect environmental protection within the ICT.
(e) A directly affected Resident, property owner, or occupier may bring a claim in respect of environmental harm that materially affects that person’s property, health, use, enjoyment, or lawful interests.
(f) Nothing in this Article shall limit the application of any Host Country law relating to endangered species, protected wildlife, biosecurity, animal welfare, public health, customs, quarantine, or environmental protection where such law applies within the ICT.
The Administration, as the owner of infrastructure areas and responsible for the entire city territory, is entitled to file claims against those responsible in cases where environmental protection concerns may be affected. Otherwise, only directly affected residents are entitled to file claims.
