Article 4.22 Duty to Seek Amicable Resolution
(a) (1) Prior to initiating any formal dispute resolution proceedings, the party asserting a claim (the Complaining Party) shall use its reasonable efforts to pursue an amicable resolution of the dispute.
(2) Such efforts shall include, at a minimum:
(a) written notice to the other party identifying the nature and basis of the dispute; and
(b) a genuine attempt to engage in dialogue and negotiate a reasonable compromise solution.
(c) (3) Compliance with this Chapter shall constitute a condition precedent to the invocation of the procedures set out in Article 4.23 and 4.11 of this Chapter, unless urgent interim relief is reasonably required to prevent irreparable harm.
