Article 4.34 Litigation in Court

(1) Exclusive Jurisdiction
(a) All disputes to which this Chapter applies as provided in Article 4.28 shall, as a matter of law and subject to Article 4.28(4), be subject to the exclusive jurisdiction of the IC Court.
(b) No other court or tribunal, whether of the Host Country or elsewhere, shall exercise jurisdiction over such disputes, except where the parties have expressly agreed in writing to submit the dispute to another court or tribunal.
(c) For the avoidance of doubt, a valid arbitration agreement or jurisdiction agreement conferring authority upon another court or tribunal shall prevail in accordance with its terms.

(b) (2) Proceedings before the IC Court pursuant to this Article shall be conducted as provided in Article 4.35 (Rules of Court), as supplemented by any Directives issued by the Chief Justice.
