Article 4.45 Scope and Residual Application
(a) This Chapter applies only where jurisdiction, competence, or the applicable legal framework for a matter arising in connection with the ICT is not clearly or exhaustively allocated by this ICT Code (including Part 5), the ICT Establishment Law or the ICT Contractual Arrangements.
(b) This Chapter shall be interpreted consistently with the ICT Establishment Law, the ICT Contractual Arrangements, and any country-specific provisions set out in Part 5.
(c) Part 5 shall prevail over this Chapter to the extent of any country-specific modification, limitation, adaptation, or deviation.
(1) This Chapter applies to civil, commercial, administrative, and criminal matters arising in connection with the International City where jurisdiction, competence, or the applicable legal framework is not clearly or exhaustively allocated by this Code, by applicable legislation, or by a valid agreement of the parties.
(2) For the purposes of this Chapter, jurisdictional uncertainty includes uncertainty as to:
(a) the competent court or tribunal;
(b) the competent prosecutorial authority in criminal matters; and
(c) the applicable procedural or adjudicative framework.
