Article 4.8 Duty of Good Faith and Non-Abuse

(a) (1) All parties, including public authorities, shall act in good faith in the initiation, conduct, and resolution of disputes.

(b) (2) The abuse of process, the bringing of proceedings in a frivolous, abusive, or bad-faith manner, or the use of dispute resolution mechanisms for improper purposes is prohibited.

(c) (3) Appropriate sanctions and remedies may be imposed against parties who act in bad faith or in material breach of these Dispute Resolution Principles.
