Article 3.8 Complaint and Redress Mechanisms
(a) (1) Residents, Investors, or affected parties may submit complaints to the Operator or, as provided in Part 4, the Ombudsman or ICT Court (as applicable) regarding:
a. Alleged misconduct, misuse of authority, or procedural failure by City personnel and security forces;
b. Failures or breaches by Emergency Services providers; or
c. Violations of detainee rights by Custodial officers.
(b) (2) Residents may submit complaints regarding misconduct, due process violations, or overreach by City Security to the Operator via the City App or other Operator established process and/or the Ombudsman as provided in Part 4. Legal remedies may be pursued through the ICT Court or other designated dispute resolution processes.
(c) (3) Complaints against administrative measures issued in writing, shall be filed within the objection period specified in the decision, which shall be at least four weeks; otherwise, further legal remedies are excluded. For administrative measures that do not specify an objection period, a complaint shall be filed within one year of the measure’s execution; otherwise, further legal remedies are excluded.
