Article 4.2 Acceptance and Binding Effect

(a) (1) For the avoidance of doubt, acceptance of these Dispute Resolution Principles shall be deemed to occur, and shall be legally binding, upon any person who:
(a) enters into a Residency Agreement or equivalent contract with the ICT or any authorised body thereof;
(b) establishes, operates, or participates in any legal entity or economic activity within the ICT; or
(c) enters, resides in, or otherwise conducts activities within the ICT, whether temporarily or permanently.

(2) Such acceptance shall further be deemed to occur, and shall be legally binding, upon any person who:
(a) by express contractual agreement, jurisdiction clause, or arbitration agreement; or
(b) by any other clear and voluntary act evidencing consent,
elects to submit a dispute to the courts, tribunals, arbitral institutions, or alternative dispute resolution mechanisms of, or associated with, the ICT, regardless of whether such person otherwise has any territorial, personal, or transactional nexus to the ICT.

(c) (3) Such acceptance shall constitute an irrevocable acknowledgment that disputes shall be resolved exclusively in accordance with these Dispute Resolution Principles and the instruments, institutions, and procedures established pursuant thereto.

(d) (4) No person shall assert ignorance of, or seek to derogate from, these Dispute Resolution Principles by reason only of nationality, domicile, residence outside the ICT, or status as a public authority.
