Article 4.4 Independence, Impartiality, and Due Process
(a) (1) All dispute resolution bodies exercising jurisdiction within the ICT shall be independent and impartial, and shall act free from improper influence, interference, or instruction from any person or authority.
(2)(b) Every party to a dispute shall be entitled to due process, including:
(ia) timely notice of proceedings;
(iib) a reasonable opportunity to be heard and to present evidence;
(iiic) procedural fairness between the parties; and
(ivd) a reasoned decision delivered within a reasonable time.
(c) (3) Decisions shall be based on law, recognised principles of equity, and the agreed legal framework of the ICT, and shall not be arbitrary or capricious.
