Article 4.5 Publicity and Transparency of Court Proceedings

(a) (1) Open justice is a fundamental principle of the administration of justice within the ICT.

(b) (2) Subject to this Article, proceedings before any court exercising jurisdiction under this Part shall be conducted in public, and judgments shall be delivered and published in full, including the reasons for decision.

(c) (3) A court may depart from the principle of open justice only where strictly necessary in the interests of justice, including for the protection of national security, confidential information, minors, vulnerable persons, or other compelling public interests.

(d) (4) Any limitation on publicity or publication shall be proportionate and no more extensive than required by the circumstances.

(e) (5) Nothing in this Article affects the confidentiality of mediation or arbitration proceedings or any related obligations under this Code, party agreement, institutional rules, or applicable law.
