Article 6.30 Bail

(a) 6.30.1 The court may on the application of the prosecutor or the accused:

(A) remand the accused in custody pending trial; or

(B) grant bail for the release of the accused pending a trial of a charge or charges on such terms as the court determines, which may include the release of the accused:

(1) on their own recognisance;

(2) upon the provision of such security as the court orders;

(3) upon such other conditions (with or without security) as the court orders,

except that bail cannot be granted where a charge is for murder or another serious charge prescribed by ICT law.

(b) 6.30.2 If an accused fails to comply with a bail condition, the court may order the arrest of the accused and remand the accused in custody pending a trial of the charge or charges.
